Our complete terms and conditions are contained below, but some important points for you to know before you become a customer are set out below:

• Our liability under these terms is limited as set out in clause 11.
• Your participation in spray tanning services may expose you to risks including skin reactions, staining, or allergic reactions.
• Cancellations made within 24 hours of your appointment will result in forfeiture of payment or conversion to credit.
• You must follow our spray tanning guidelines to ensure optimal results.
• We may receive a benefit (which may include a referral fee or a commission) should you visit certain third-party websites via a link on the Site or for featuring certain products or services on the Site.

Nothing in these terms limits your rights under the Australian Consumer Law.

1. Introduction

This website (Site) is operated by Six Gold Stars Pty Ltd trading as Cube Fitness Pty Ltd (ACN 661 981 479) (we, our or us). These terms and conditions (Terms) are between us and you, the person booking spray tanning services through the Site or in person.

2. Acceptance and Use of Services

You accept these Terms by booking a spray tanning appointment via the Site, in person, or by attending your appointment.

You must be at least 16 years old to book and use our spray tanning services. If you are under 18 years of age, you must have written consent from a parent or guardian before booking, and a parent or guardian must be present during your appointment.

You must not:

• Provide false or misleading information about your health or medical conditions.
• Attend your appointment under the influence of alcohol or drugs.
• Engage in behaviour that may cause harm to yourself, our staff, or other clients.
• Use our facilities for any unlawful purposes.
• Facilitate or assist a third party to do any of the above acts.

3. Accounts

You may book spray tanning services as a guest without creating an account, or you may choose to create an account for easier future bookings.

You are responsible for keeping your account details confidential and for all activity on your account.

4. Booking and Services

• You may book individual spray tanning appointments or purchase packages through our Site or in person.
• We may, at our absolute discretion, accept or reject any booking.
• Once we accept your booking, a binding agreement is formed for the provision of spray tanning services.
• All bookings are subject to availability and staff scheduling.
• Appointment confirmations will be sent via email or SMS.

5. Price and Payments

• Full payment is required at the time of booking.
• All amounts are stated in Australian Dollars and include GST where applicable.
• Payment must be made using the methods offered on the Site.
• Fraudulent or unlawful payment methods are prohibited.
• Promotional discount codes may be offered from time to time and must be applied at checkout.

For clients under 18 years of age:

A parent or guardian must provide written consent and be present during the appointment.

Important Health Warnings

• Spray tanning may cause allergic reactions, skin irritation, or respiratory issues in some individuals.
• Pregnant or breastfeeding women should consult their doctor before using our services.
• Persons with certain medical conditions or taking medications that affect skin sensitivity should seek medical advice.
• Temporary staining of clothing, bedding or other materials may occur.

You represent and warrant that:

• You have disclosed all relevant medical conditions, allergies and medications.
• You are not suffering from any skin condition that may be aggravated by spray tanning.
• You will follow all pre and post tanning guidelines provided.
• You understand the risks associated with spray tanning.

7. Spray Tanning Guidelines

We provide comprehensive guidelines covering:

• Pre-appointment preparation.
• What to wear during your appointment.
• Post-appointment care instructions.
• Expected results and development timeline.

You acknowledge and agree that:

• Failure to follow our guidelines may result in unsatisfactory results.
• We cannot guarantee specific results.
• Following our guidelines is essential for optimal results.

8. Cancellation Policy

• More than 24 hours before your appointment: Full refund available.
• Less than 24 hours before your appointment: No refund. The appointment fee will be forfeited or converted to credit for future use at our discretion.
• No-show appointments will result in full forfeiture of the appointment fee.
• Credits issued must be used within 6 months of the issue date or they will expire.
• Appointments may be rescheduled with at least 24 hours' notice, subject to availability.
• You may have additional rights under the Australian Consumer Law.

9. Australian Consumer Law

Nothing in these Terms attempts to modify or exclude any conditions, warranties, undertakings or other rights available under the Australian Consumer Law.

Our services come with guarantees that cannot be excluded under Australian Consumer Law. You may be entitled to remedies for major failures and compensation for any reasonably foreseeable loss or damage.

Where a valid claim exists under Australian Consumer Law, we will assess the issue and provide an appropriate remedy, which may include:

• Re-performance of the service at no additional cost.
• Partial refund.
• Full refund of the service fee.

10. Limitations

Subject to your rights under Australian Consumer Law and to the maximum extent permitted by law:

• Neither party will be liable for consequential loss.
• Each party’s liability will be reduced proportionately where the loss was caused or contributed to by the acts or omissions of the other party.
• Our total liability arising from or in connection with these Terms will be limited to the amount paid by you for the relevant spray tanning service.

11. Risk Warning and Waiver

Spray tanning carries inherent risks including, but not limited to:

• Allergic reactions or skin sensitivity.
• Temporary staining of skin, clothing or other materials.
• Respiratory irritation caused by spray mist.
• Slip hazards from spray tanning solutions.
• Uneven or unsatisfactory colour results.

You acknowledge and voluntarily accept these risks and agree to participate at your own risk to the maximum extent permitted by law.

12. Intellectual Property

All intellectual property developed, adapted, modified or created by us, including content on this Site and materials connected with our services, remains our property at all times.

You must not use our intellectual property for commercial purposes, including advertising, resale or revenue-generating activities, without our prior written consent.

You must not copy, reproduce, distribute, publish, modify, frame, embed or create derivative works from our intellectual property without our prior written permission.
